{"id":6157,"date":"2026-02-03T10:05:41","date_gmt":"2026-02-03T10:05:41","guid":{"rendered":"https:\/\/oneofus.eu\/?p=6157"},"modified":"2026-02-13T16:37:25","modified_gmt":"2026-02-13T16:37:25","slug":"one-of-us-juridical-analysis-of-the-european-citizens-initiative-my-voice-my-choice-regarding-the-competences-of-the-european-union","status":"publish","type":"post","link":"https:\/\/oneofus.eu\/hu\/one-of-us-juridical-analysis-of-the-european-citizens-initiative-my-voice-my-choice-regarding-the-competences-of-the-european-union\/","title":{"rendered":"One of Us \u2013 Juridical Analysis of the European Citizens\u2019 Initiative \u201cMy Voice My Choice\u201d regarding the Competences of the European Union"},"content":{"rendered":"<h2 class=\"wp-block-heading\"><strong>First, let\u2019s have a look on the background:&nbsp;<\/strong><\/h2>\n\n\n\n<p>The European Citizens\u2019 Initiative (ECI) <em>\u201cMy Voice My Choice\u201d<\/em> calls for the establishment of a <strong>European funding mechanism for abortion<\/strong>, aiming to finance access to abortion for women who cannot obtain it in their home countries.<\/p>\n\n\n\n<p>This proposal would, for instance, enable a woman residing in France\u2014where abortion is prohibited beyond 14 weeks except in limited cases\u2014to receive EU funding to travel to another Member State, such as the Netherlands, to undergo the procedure, until 24th weeks\u2019pregnancy.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Once this is said, which is the <\/strong><strong>Legal and Institutional Context?<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. First of all, we must look at <\/strong><strong>the Competences of the European Union in Health and Family Matters<\/strong><\/h4>\n\n\n\n<p>Under the <strong>Treaty on the Functioning of the European Union (TFEU)<\/strong>, the EU\u2019s competences in the field of <strong>public health<\/strong> and <strong>family policy<\/strong> are <strong>supporting and coordinating<\/strong>, not legislative or harmonizing.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 6 TFEU<\/strong> \u2013 The Union may carry out actions to support, coordinate, or supplement the actions of the Member States.<br><\/li>\n\n\n\n<li><strong>Article 168 TFEU<\/strong> \u2013 The Union shall complement national policies to improve public health, but \u201cthe organization and delivery of health services and medical care shall remain the responsibility of the Member States.\u201d<br><\/li>\n<\/ul>\n\n\n\n<p>Therefore, <strong>abortion policy remains an exclusive competence of the Member States.<\/strong> The EU cannot finance, legislate, or create mechanisms that would <strong>circumvent national laws<\/strong> or <strong>influence moral and ethical choices reserved to national sovereignty, <\/strong>even more in such delicate issues as those regarding maternity and abortion.<\/p>\n\n\n\n<p>Creating an EU fund for abortion would amount to an <strong>indirect harmonization<\/strong> of national health and bioethical policies, contrary to the <strong>principle of subsidiarity<\/strong> enshrined in <strong>Article 5(3) TEU<\/strong>.<\/p>\n\n\n\n<p><strong>2. As a 2d fundamental document, we must know now attentively read <\/strong><strong>The Charter of Fundamental Rights of the European Union \u2013 Article 33<\/strong><\/p>\n\n\n\n<p><strong>Article 33 of the Charter<\/strong> establishes rights relating to <strong>family and professional life<\/strong>:<\/p>\n\n\n\n<p>\u201c1. The family shall enjoy legal, economic and social protection.<br>2. To reconcile family and professional life, everyone shall have the right to protection from dismissal for a reason connected with maternity and the right to paid maternity leave and to parental leave following the birth or adoption of a child.\u201d<\/p>\n\n\n\n<p>This article emphasizes the <strong>protection of family life and maternity<\/strong>, not the promotion or facilitation of abortion.<\/p>\n\n\n\n<p>EU directives implementing Article 33 (e.g., Directive (EU) 2019\/1158 on work-life balance for parents and carers) explicitly refer to <strong>\u201cthe best interests of the child\u201d<\/strong> as a guiding principle.<\/p>\n\n\n\n<p>Consequently, <strong>redirecting EU funds to finance abortion would contradict the spirit and legal framework of Article 33<\/strong>, which recognizes maternity and the family as values deserving protection\u2014not elimination.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3<\/strong><strong>. Finally, we should observe which is the <\/strong><strong>Use of European Public Funds<\/strong><\/h4>\n\n\n\n<p>Historically, the EU has financed <strong>hundreds of programmes<\/strong> promoting <strong>family cohesion, social inclusion, and support for vulnerable mothers<\/strong>.<\/p>\n\n\n\n<p>Example: an EU-funded project in Italy supported isolated rural families who struggled to raise children, helping them regain economic and emotional stability. Some participants even chose to have additional children because of this support.<\/p>\n\n\n\n<p>Such programmes are consistent with Article 33\u2019s objectives and the <strong>social cohesion goals<\/strong> of the Union (Articles 151 and 174 TFEU).<\/p>\n\n\n\n<p>However, recent funding trends have shifted toward <strong>ideologically driven projects<\/strong>, including those introducing <strong>gender theory<\/strong> or <strong>promoting abortion<\/strong>, while programmes directly supporting maternity have been discontinued.<\/p>\n\n\n\n<p>This raises legitimate concerns regarding the <strong>proportionality<\/strong> and <strong>appropriate use of EU taxpayers\u2019 money<\/strong>, given that <strong>a large majority of European citizens expect EU funds to promote life, family, and social well-being<\/strong>, not the financing of morally divisive procedures.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ethical and Social Considerations <\/strong><strong>are not the least aspects to look deeply inside&nbsp;<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. Denial of Women\u2019s Suffering<\/strong><br>According to an IFOP poll (2025), <strong>88% of women<\/strong> report that abortion \u201cleaves painful marks.\u201d<\/h4>\n\n\n\n<p>Framing abortion as a \u201cright\u201d or \u201cchoice\u201d overlooks this psychological and emotional reality, and initiatives such as <em>\u201cMy Voice My Choice\u201d<\/em> risk <strong>instrumentalizing women\u2019s pain<\/strong> for ideological purposes.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. The Double Denial<\/strong><\/h4>\n\n\n\n<p>What more worries thousands of citizens all over Europe is the <strong>double denial<\/strong> the initiative represents:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A <strong>denial of women\u2019s suffering<\/strong> by reducing abortion to a political slogan.<\/li>\n\n\n\n<li>A <strong>denial of the unborn child\u2019s existence<\/strong>, erasing the moral and human dimension of life protection.<\/li>\n<\/ul>\n\n\n\n<p>This dual negation aggravates the emotional wounds associated with abortion and undermines authentic <strong>women\u2019s rights<\/strong>, which should include <strong>the right to be supported in motherhood<\/strong>.<\/p>\n\n\n\n<p>Europe as an Institution and European citizens: men and women, disserve other proposals as more numbers of abortions and, as a mentality, the banalization of abortion.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>In <\/strong><strong>Conclusion and <\/strong><strong>as a<\/strong><strong> Legal Assessment<\/strong><\/h3>\n\n\n\n<p>The proposed funding mechanism under <em>\u201cMy Voice My Choice\u201d<\/em> is <strong>incompatible with the legal framework of the European Union<\/strong>, for the following reasons:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Lack of Competence<\/strong>: The EU has no legal authority to create or finance mechanisms facilitating abortion across borders (Articles 6, 168 TFEU).<br><\/li>\n\n\n\n<li><strong>Violation of Subsidiarity<\/strong>: The initiative bypasses national competences on health, family, and morality.<br><\/li>\n\n\n\n<li><strong>Contradiction with the EU Charter<\/strong>: Article 33 protects maternity and family life; EU action should support\u2014not undermine\u2014these principles.<br><\/li>\n\n\n\n<li><strong>Misuse of Public Funds<\/strong>: EU taxpayers\u2019 money should prioritize programmes that strengthen families, protect vulnerable women, and promote the best interests of children.<br><\/li>\n\n\n\n<li><strong>Ethical Inconsistency<\/strong>: By denying the suffering of women and the dignity of unborn life, the initiative undermines genuine human rights and social solidarity.<br><\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Recommendation<\/strong><\/h3>\n\n\n\n<p>The European Commission and the College of Commissioners should <strong>reject the ECI \u201cMy Voice My Choice\u201d<\/strong> as <strong>legally unfounded and ethically inconsistent with the EU\u2019s fundamental values<\/strong>.<\/p>\n\n\n\n<p>Instead, they should consider new initiatives and funding programmes under <strong>Article 33 of the Charter<\/strong> to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Promote <strong>Maternity protection<\/strong>,<br><\/li>\n\n\n\n<li>Support <strong>vulnerable families<\/strong>, \u00e9s<br><\/li>\n\n\n\n<li>Strengthen <strong>the social and economic protection of the family<\/strong> across Europe.<br><\/li>\n<\/ul>\n\n\n\n<p><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">Une telle r\u00e9orientation permet d&#8217;aligner l&#8217;action de l&#8217;UE \u00e0 la fois sur ses <\/font><\/font><\/font><\/font><strong><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">comp\u00e9tences juridiques<\/font><\/font><\/font><\/font><\/strong><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"> et sur <\/font><\/font><\/font><\/font><strong><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">sa responsabilit\u00e9 morale<\/font><\/font><\/font><\/font><\/strong><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\"> envers les femmes, les enfants et la famille.<\/font><\/font><\/font><\/font><\/p>","protected":false},"excerpt":{"rendered":"<p>First, let\u2019s have a look on the background:&nbsp; The European Citizens\u2019 Initiative (ECI) \u201cMy Voice My Choice\u201d calls for the establishment of a European funding mechanism for abortion, aiming to finance access to abortion for women who cannot obtain it in their home countries.
